Cancellation and Refund Policy

Gervay Studio Pty Ltd reserves the right to amend any class, program, schedule or tutor. If this arises we will endeavour to provide a substitute class, program, schedule or tutor. Where no suitable substitute is available, a refund or credit will be offered. Should a class be cancelled due to insufficient enrolments, any student enrolled in that class will be contacted and an alternative class at a suitable time will be arranged, or a refund or credit provided if no suitable alternative is available. This does not limit your rights under the Australian Consumer Law.

Please choose carefully as fees are non-refundable. Purchased classes or gift vouchers can be changed to a date that is agreed upon between the tutor and the student. 

Full payment must be made prior to the commencement of the class. Gervay Studio Pty Ltd cannot accept responsibility for changes to students’ personal circumstances that prevent attendance. Classes missed are the student’s responsibility and are non-refundable. This does not limit your rights under the Australian Consumer Law.

Cancellation of Enrolment

If you choose to withdraw from a class or program you may transfer the remaining value to another person, to be used within 3 months of the date payment was received. Refunds are not provided. This does not limit your rights under the Australian Consumer Law.

Payment of Fees

Class/program fees are listed with the class/program details on our website. Payment of the full class/program fee via online credit card payment is required at the time of enrolment to secure your place.

Course Recognition

Gervay Studio Pty Ltd is not a Registered Training Organisation and as such, classes and programs are not accredited, we do however strive to deliver excellence in art education.

Gervay Studio Pty Ltd Marketing

From time to time we take photos or videos during class of students and their artworks. These are used for Gervay Studio Pty Ltd promotional purposes such as press advertising, brochures, social media, editorials and our website. Photos and videos will never be sold and will be used exclusively by and for Gervay Studio Pty Ltd.

As part of enrolment, you will be asked to indicate your consent for photos and/or videos of your child and their artwork to be used in this way. You can change your mind at any time — simply notify us in writing at support@rosgervayart.com and we will remove any published content within a reasonable timeframe.

Student Conduct

Gervay Studio Pty Ltd is a shared space and we expect students to respect fellow artists, artwork and property. Discrimination on the grounds of a person’s age, race, sex, gender, sexuality, marital status, physical or intellectual disability, or religion will not be tolerated. Any inappropriate or disruptive behaviour may result in removal from the class. In this instance a refund will not be provided. It should also be noted that cleaning of the class art space and common areas is a shared responsibility.

Punctuality

Out of respect for other students and tutors, students are requested to be punctual for class, please arrive on time and pick up your child on time. If you plan to arrive late or leave after the class or program has commenced, please inform the tutor. No before or after care is currently provided for after school art students.

Expectations of Students

Students are to have their working area clean and tidy. All tools are to be cleaned and returned to their respective areas by the end of class.

Students or their guardians must notify Gervay Studio Pty Ltd of changes to personal details.

Students must wear or bring appropriate attire suitable for painting and art classes. Gervay Studio Pty Ltd is not responsible for any loss or damage to personal property including clothing.

Students are not to hinder other students’ ability to listen and learn during classes.

Any student who disrupts classes or is abusive, threatening or violent will be asked to leave and may result in removal from the program. In this instance, any course fees will be forfeited.

Mobile phones are to be turned to silent during all classes.

It is the student’s responsibility to collect their own artwork. Any art uncollected will be discarded after 5 business days unless special arrangements are made with Gervay Studio Pty Ltd.

When using all materials and equipment provided by Gervay Studio Pty Ltd students are required to observe and follow the instructions available relating to cleaning, handling and storing.

Sometimes, due to unforeseen circumstances, a class may be cancelled unexpectedly. Students or their guardians are advised to check their email inbox before coming to class. Any cancelled class by Gervay Studio Pty Ltd will be rescheduled to a suitable time, or a refund provided if no suitable alternative is available. This does not limit your rights under the Australian Consumer Law.

Work Health and Safety Policy

Gervay Studio Pty Ltd is committed to the active promotion of Work Health and Safety for all tutors and students.

Tutors and students are responsible for their own health, safety and welfare. Students are asked to be mindful of other students regarding their health and safety within the studio environment.

Students should report unsafe conditions, faulty equipment and accidents to the tutor immediately.

Students should abide by safe practices and comply with health and safety regulations.

Valuables

Gervay Studio Pty Ltd accepts no responsibility for the loss or damage to any personal items or art materials belonging to students including clothing.

Student Work

Gervay Studio Pty Ltd accepts no responsibility for the loss or damage to student work left in the studio. Students are encouraged to take their work home when finished unless required for the next class.

Pricing

All prices on this website are in Australian dollars and are subject to change. Prices include GST (if any) unless otherwise marked.

Privacy Policy

When you send us an email, register your contact details or enrol in a class or program, we collect personal information including your child's name, date of birth, emergency contact details, medical and allergy information, authorised pickup details, and your own contact details as the enrolling parent or guardian. This information is collected for the purposes of enrolment administration, class delivery, and the safety and wellbeing of your child.

We handle personal information in accordance with the Australian Privacy Principles under the Privacy Act 1988 (Cth).

Your information is stored securely and access is limited to Gervay Studio Pty Ltd staff directly involved in delivering your child's program. We retain your information only for as long as necessary to administer your enrolment and meet our legal obligations, after which it is securely destroyed or de-identified.

We will not disclose your contact details to any third parties for marketing purposes without your express consent, except where required by law. We do use third-party service providers (such as our booking, payment and email platforms) to help operate our business, and your information may be processed by these providers solely for that purpose.

Our website may use cookies and similar tracking technologies, including tools such as Google Analytics and Meta Pixel, to understand how visitors use our site and to inform our advertising, including on social media platforms. These tools may collect information such as your browser type, pages visited, and general location, and may be used to show you relevant advertising based on your visit to our website. You can manage or disable cookies at any time through your browser settings.

Gervay Studio Pty Ltd will from time to time send emails to students and past students for the purpose of marketing. Should you not wish to receive these, you can unsubscribe at any time using the link provided or by notifying us at support@rosgervayart.com.

You may request access to, or correction of, the personal information we hold about you or your child at any time by contacting support@rosgervayart.com. If you have a concern about how we've handled your personal information, please contact us in the first instance; if you remain unsatisfied, you may raise your concern with the Office of the Australian Information Commissioner (OAIC).

We do not retain any credit card information that you may provide.

Child Safety

Gervay Studio Pty Ltd is committed to the safety and wellbeing of every child in our care, in line with Australia's National Principles for Child Safe Organisations.

All staff and volunteers who work directly with children hold a current Working With Children Check, verified prior to commencing work with us.

Children are supervised at all times during class. A staff member with current first aid training, including CPR, is present at all classes and programs. Wherever possible, more than one adult is present in the room, and no staff member is left alone with a single child outside the view of others.

Staff are expected to maintain professional boundaries with students at all times, and do not contact students privately or via personal social media or messaging outside of class-related communication with parents and guardians.

Children will only be released at the end of class to a parent, guardian, or another person specifically authorised on your enrolment form. Staff may request identification from anyone unfamiliar collecting a child.

Any injury, incident or concern involving a child during class is documented, and parents or guardians are notified as soon as practicable.
